The Platform is intended for use by individuals who are at least 18 (eighteen) years of age. By creating an account or using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

Use of the Platform by persons below 18 years of age is strictly prohibited. Cherry Glitz does not knowingly collect personal information from minors. If Cherry Glitz discovers that a minor has created an account, it shall immediately suspend and delete such account.

To access certain features of the Platform (including making Bookings), you must create an account by providing your name, mobile number, email address, and such other information as Cherry Glitz may require.

Account creation shall be verified via a One-Time Password (OTP) sent to your registered mobile number. By submitting an OTP, you confirm ownership of and consent to the use of that mobile number on the Platform.

You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify Cherry Glitz at hello.cherryglitz@gmail.com if you suspect any unauthorised access to your account. Cherry Glitz shall not be liable for any loss arising from unauthorised use of your account resulting from your failure to safeguard your credentials.

Each person may maintain only one active account on the Platform. Cherry Glitz reserves the right to merge or terminate duplicate accounts.

You agree to keep your account information updated at all times. Providing false, inaccurate, or outdated information constitutes a breach of these Terms and may result in account suspension.

The Platform allows you to browse Beauty Partners, view their services, pricing, availability, and Customer reviews, and make Bookings directly through the Platform interface.

A Booking is considered confirmed only upon your receipt of a confirmation notification (via SMS, email, or in-app notification) from Cherry Glitz. A booking request placed but not yet confirmed does not constitute a confirmed appointment.

You must provide accurate information when making a Booking, including your address (for home service bookings), preferred date and time, specific service requirements, and any health conditions or allergies relevant to the service. Cherry Glitz and the Beauty Partner shall not be responsible for issues arising from inaccurate information provided by you.

Cherry Glitz shall use reasonable efforts to ensure that Beauty Partner availability displayed on the Platform is accurate. However, appointment timings are indicative and subject to operational factors, ongoing services, traffic conditions, partner availability, and unforeseen circumstances. Minor delays in service commencement may occasionally occur and, under normal circumstances, are generally expected not to exceed 20 minutes. Cherry Glitz does not guarantee exact appointment start times.

A confirmed Booking creates a direct service agreement between you and the relevant Beauty Partner. Cherry Glitz is not a party to this service agreement.

All payments for Bookings shall be made through the Platform using the payment methods available, including UPI, credit/debit cards, net banking, and digital wallets. All transactions are processed through Razorpay or such other PCI-DSS compliant payment gateway designated by Cherry Glitz.

Prices displayed on the Platform are set by Beauty Partners and are inclusive of applicable taxes unless otherwise stated.

Cherry Glitz may charge a platform convenience fee or service fee on Bookings, which shall be clearly disclosed prior to the checkout confirmation step. By completing a Booking, you accept the total amount displayed at checkout, including any such fees.

Cherry Glitz shall not be responsible for any payment failures arising from issues with your bank, payment gateway, or device. In the event of a payment failure after a Booking is confirmed, Cherry Glitz reserves the right to cancel the Booking.

Cherry Glitz Credits / Wallet: Cherry Glitz may offer a platform wallet or promotional credits. Credits are non-transferable, non-refundable for cash, and expire as specified at the time of issuance. Credits cannot be combined with other offers unless specifically stated.

By using the Platform, you authorise Cherry Glitz to charge the payment method on file for the total confirmed Booking amount, including fees and applicable taxes.

Beauty Partner-Initiated Cancellations: If a Beauty Partner cancels a confirmed Booking, you shall receive a full refund. Cherry Glitz shall use reasonable efforts to assist you in rebooking with another available partner.

Refund Processing: Eligible refunds shall be processed to the original payment method within 5–7 (five to seven) business days. Refunds involving wallet credits or promotional offers may follow different timelines as communicated.

Disputed Services:If you believe a Service was not rendered or was materially substandard, you must raise a complaint within 24 (twenty-four) hours of the scheduled appointment through the Platform's complaints mechanism. Cherry Glitz shall investigate the complaint and its decision on refund eligibility shall be final and binding.

Cherry Glitz reserves the right to modify the cancellation and refund policy from time to time. The policy in effect at the time of Booking shall apply.

You may reschedule a confirmed Booking without charge up to 12 (twelve) hours before the scheduled appointment, subject to the Beauty Partner's availability.

Reschedule requests made within 12 hours of the appointment shall be treated as a cancellation under Clause 5 above, and the applicable cancellation charges shall apply.

Rescheduling is subject to the Beauty Partner's confirmed availability at the new time. Cherry Glitz does not guarantee that the same Beauty Partner will be available for the rescheduled slot.

Cherry Glitz makes no representation, guarantee, or warranty regarding the outcome, quality, safety, or effectiveness of any beauty or wellness service provided by a Beauty Partner. Results may vary based on individual factors including skin type, health conditions, and the application of products.

You acknowledge that beauty and wellness services involve an inherent element of personal preference and subjective satisfaction. Dissatisfaction with a service outcome alone, in the absence of demonstrable negligence by the Beauty Partner, shall not constitute grounds for a full refund.

Cherry Glitz is an "intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000. Cherry Glitz does not supervise, direct, control, endorse, guarantee, or assume liability for the actual provision of any Service by a Beauty Partner.

The contract for the provision of Services is made directly between you and the Beauty Partner. Cherry Glitz is not a party to this service contract.

Cherry Glitz is not responsible for the quality, safety, legality, hygiene, or professional standards of any Beauty Partner or the services they render.

Cherry Glitz endeavours to list reputable Beauty Partners and conducts periodic quality checks. However, such checks do not constitute a guarantee or endorsement of the Beauty Partner's services.

Any attempt to make fraudulent Bookings, exploit refund policies, engage in chargeback fraud, use stolen or unauthorised payment instruments, or otherwise misuse the Platform shall constitute a serious breach of these Terms.

Cherry Glitz employs fraud detection systems and algorithms to identify suspicious activity. Users flagged for suspicious activity may have their accounts suspended pending investigation without prior notice.

Cherry Glitz reserves the right to blacklist Users found guilty of fraud, misuse, or abuse and to recover all losses, including legal costs, from such Users.

Cherry Glitz may report fraudulent activity to law enforcement authorities and cooperate with any investigation as required by law.

Cherry Glitz allows Customers who have completed a Booking to post ratings and reviews of Beauty Partners. Reviews must be based on genuine personal experience and must not violate these Terms or Cherry Glitz's content guidelines.

By submitting a review or any other content on the Platform, you grant Cherry Glitz a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, display, and distribute such content on the Platform and in Cherry Glitz's marketing and promotional materials.

Cherry Glitz reserves the right to remove, moderate, or refuse to publish any review or content that violates these Terms or its content guidelines, without notice or liability.

Cherry Glitz uses automated and manual systems to detect and remove fake, spam, or manipulated reviews. Users who submit fake reviews may face account suspension.

All content on the Platform, including but not limited to the Cherry Glitz name, logo, design, graphics, text, software, code, and user interface, is the exclusive intellectual property of Cherry Glitz Private Limited or its licensors and is protected under Indian and international intellectual property laws.

You may not reproduce, copy, distribute, publicly display, adapt, transmit, or create derivative works of any Cherry Glitz Content without the prior written consent of Cherry Glitz.

Any feedback, suggestions, or ideas you share with Cherry Glitz regarding the Platform may be used by Cherry Glitz without any obligation to compensate you.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CHERRY GLITZ MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PLATFORM, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHERRY GLITZ'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THE PLATFORM OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO CHERRY GLITZ IN THE 3 (THREE) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms shall limit Cherry Glitz's liability for fraud, wilful misconduct, or death or personal injury caused by Cherry Glitz's own negligence, to the extent such limitation is prohibited by Applicable Law.

All Services are rendered by independent Beauty Partners who are not employees, agents, or representatives of Cherry Glitz. Cherry Glitz does not supervise, direct, or control the manner in which Beauty Partners render Services.

Beauty Partners are responsible for their own compliance with Applicable Law, including professional licensing, health and safety regulations, labour laws, and tax obligations.

Cherry Glitz cannot guarantee that any Beauty Partner will meet or maintain any specific standard, certification, or level of quality. You are encouraged to review ratings and reviews before making a Booking.

Any dispute, complaint, or legal action arising directly from the provision (or failure to provide) Services shall be primarily between you and the relevant Beauty Partner. Cherry Glitz shall provide reasonable assistance in facilitating resolution as set out in these Terms.

By using the Platform, you consent to the collection, use, storage, and processing of your personal data in accordance with Cherry Glitz's Privacy Policy (available at www.cherryglitz.com/privacy), which is incorporated into these Terms by reference.

Cherry Glitz collects and uses your personal data for purposes including account management, facilitating Bookings, processing payments, personalising your experience, sending service communications, and complying with legal obligations.

Cherry Glitz shall share your name, contact number, and booking details with the relevant Beauty Partner solely for the purpose of fulfilling your Booking. You consent to such sharing.

Cherry Glitz shall not sell, rent, or trade your personal data to third parties for their own marketing purposes.

You have the right to access, correct, delete, or port your personal data in accordance with Cherry Glitz's Privacy Policy and Applicable Law. Requests may be submitted to hello.cherryglitz@gmail.com.

Cherry Glitz complies with the Information Technology Act, 2000, the IT (Reasonable Security Practices) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (to the extent in force).

By You: You may delete your account at any time through the app settings. Cancellation charges for pending Bookings shall apply as per Clause 5. Account deletion requests shall be processed within 30 (thirty) days, following which your personal data shall be erased or anonymised, subject to retention obligations under Applicable Law.

Upon termination, all rights granted to you under these Terms shall cease immediately. Any outstanding financial obligations shall survive termination.

This indemnification obligation shall survive termination or expiry of these Terms.

These Terms shall be governed by and construed in accordance with the laws of India, including the Consumer Protection Act, 2019, the IT Act, 2000, the Indian Contract Act, 1872, and all other applicable statutes.

Subject to Clause 19 (Arbitration), the courts of Odisha, India shall have exclusive jurisdiction over any matter not subject to arbitration.

In the event of a dispute between you and Cherry Glitz, both parties shall first attempt resolution through good-faith negotiation within 30 (thirty) days of written notice of the dispute.

If the dispute is not resolved through negotiation, it shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, or appointed in accordance with the Act.

The seat of arbitration shall be Bhubaneswar, Odisha, India. Proceedings shall be conducted in English.

Nothing in this clause shall prevent you from approaching the appropriate Consumer Disputes Redressal Forum / Commission under the Consumer Protection Act, 2019, which right is expressly preserved.

Cherry Glitz reserves the right to modify, update, or revise these Terms at any time. Material changes shall be communicated to you via in-app notification, email, or a prominent notice on the Platform at least 7 (seven) days prior to the changes taking effect.

Your continued use of the Platform after the effective date of any revision constitutes your acceptance of the revised Terms. If you do not agree with any revision, you should discontinue use of the Platform before the revised Terms take effect.

The most current version of these Terms shall always be available on the Platform at www.cherryglitz.com/terms.

Entire Agreement: These Terms, together with the Privacy Policy and any other policies or guidelines incorporated by reference, constitute the entire agreement between you and Cherry Glitz with respect to your use of the Platform.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Failure by Cherry Glitz to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment:You may not assign your rights or obligations under these Terms without Cherry Glitz's prior written consent. Cherry Glitz may freely assign its rights and obligations.

Force Majeure: Cherry Glitz shall not be liable for any failure or delay in performance due to causes beyond its reasonable control.

Electronic Records: Electronic records maintained by Cherry Glitz in connection with these Terms and any Booking shall be admissible as evidence and shall have the evidentiary weight accorded to written records under the IT Act, 2000, and the Indian Evidence Act, 1872.

Electronic Consent Validity: Your acceptance of these Terms through account creation, OTP verification, or any other electronic means constitutes a valid and binding electronic signature under the IT Act, 2000.
